“Playing politics’: the racial disparities in the policing of the first amendment’

Abstract: Throughout America, the protections on speech afforded by first amendment are unequally applied across the citizenry, and even disregarded for some. Those that have their rights suppressed or denied are often those in opposition to racial hierarchies. Supporting legal cases include the National Socialist Party of America v. Village of Skokie and Shuttlesworth v. City of Birmingham; the 2017 ‘Unite the Right’ riots in Charlottesville and the protests in Los Angeles in 2020 reflect aspects of these racial hierarchies. In this presentation, I will discuss how legislation has favored the freedom of expression of those in power without protecting marginalized groups, as well as some potential solutions to the problem of protecting the disenfranchised.
